Banter Terms of Service

These Terms of Service ("Terms") govern your use of the Banter mobile application, website, and related services (collectively, the "Service") operated by Refond, Inc. ("Banter," "we," "our," or "us").

By creating an account or using Banter, you agree to these Terms.

If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old (or the minimum legal age in your jurisdiction) to use Banter.

By using the Service, you represent that:

• You meet the age requirements

• You can enter into legally binding agreements

• You will comply with these Terms

If you use Banter on behalf of an organization, you represent you have authority to bind that organization.

2. Description of the Service

Banter provides AI-powered conversational partners designed to help users practice languages through text and voice interactions.

Features may include:

• AI-generated conversation responses

• Voice input and speech recognition

• AI-generated speech and audio

• Conversation memory and personalization

• Language learning tools

The Service uses third-party AI providers to generate responses.

AI responses are generated automatically and may occasionally be inaccurate.

3. User Accounts

You are responsible for:

• Maintaining the confidentiality of your account

• All activity under your account

• Providing accurate information

You may not:

• Share your account with others

• Use another person’s account without permission

• Impersonate others

We may suspend or terminate accounts that violate these Terms.

4. User Content

You retain ownership of content you submit, including:

• Messages

• Audio recordings

• Profile information

However, by using the Service, you grant Banter a worldwide, non-exclusive, royalty-free license to:

• Process your content

• Transmit your content to AI providers

• Store your content

• Use your content to provide and improve the Service

This license exists solely to operate Banter.

We do not sell your content.

5. AI-Generated Content Disclaimer

Banter uses artificial intelligence to generate responses.

You acknowledge that:

• AI responses are automated

• Responses may be inaccurate, incomplete, or incorrect

• AI responses do not constitute professional advice

You should not rely on Banter for:

• Legal advice

• Medical advice

• Financial advice

Use of AI responses is at your own risk.

6. Acceptable Use

You agree not to:

• Use Banter for illegal purposes

• Harass, threaten, or abuse others

• Attempt to reverse engineer the Service

• Interfere with the Service’s operation

• Upload malicious code

• Attempt to access unauthorized systems

We may suspend or terminate accounts violating these rules.

7. Subscriptions and Payments

Some features require a paid subscription.

Subscriptions may be billed through:

• Apple App Store

• Google Play Store

• Other payment providers

Subscriptions automatically renew unless canceled.

You can cancel anytime through your App Store account settings.

All payments are non-refundable except where required by law.

Apple and Google manage billing and refunds.

8. Intellectual Property

The Service, including software, design, branding, and content provided by Banter, is owned by Refond, Inc.

You may not:

• Copy

• Modify

• Distribute

• Reverse engineer

any part of the Service without permission.

"Banter" and related branding are protected trademarks.

9. Termination

We may suspend or terminate your account if you:

• Violate these Terms

• Misuse the Service

• Create security risks

You may terminate your account at any time through Settings.

Upon termination, your right to use the Service ends immediately.

10. Privacy

Your use of Banter is also governed by our Privacy Policy:

The Privacy Policy explains how we collect and use your data.

11. Third-Party Services

Banter uses third-party providers, including AI providers, hosting providers, and payment processors.

We are not responsible for third-party services.

Their use is governed by their own terms and policies.

12. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE."

We do not guarantee that the Service will be:

• Error-free

• Uninterrupted

• Fully accurate

To the maximum extent permitted by law, Banter disclaims all warranties.

13. Limitation of Liability

To the maximum extent permitted by law, Banter shall not be liable for:

• Indirect damages

• Lost profits

• Lost data

• Service interruptions

Our total liability shall not exceed the amount you paid us in the past 12 months.

14. Indemnification

You agree to indemnify and hold harmless Banter and its employees from claims arising from:

• Your use of the Service

• Your violation of these Terms

• Your misuse of AI features

15. Changes to the Service

We may:

• Modify features

• Add or remove functionality

• Update the Service

We may also update these Terms.

Continued use means you accept updates.

16. Governing Law

These Terms are governed by the laws of the State of Delaware, United States.

Disputes will be resolved in Delaware courts.
